This page will answer your questions regarding Sacred Sound Lab (henceforth referred to as “Sacred Sound Lab”, “SSL”, “Company”, or “we”) terms of service for the August 2024 Sacred Sound Lab Retreat. It is your responsibility to fully understand the terms and conditions. Should you have questions regarding the terms and conditions, we are available for consultation and would be happy to clarify any areas in advance of signing a contract with us. 

The retreat location is the Crestone Mountain Zen Center, henceforth referred to as “CMZC”. 

Sacred Sound Lab reserves the right to correct errors or omissions at any time, unaffected portions will continue to remain valid.

PAYMENT TERMS, CANCELLATIONS 

1. Retreat Pricing 

All prices are per person and are set well in advance of the retreat start date. Prices include meals, tuition and lodging only (except in the case where Participant selects “off-site accommodations” - lodging is not included in that case and is the responsibility of the Participant). Retreat prices do not include travel costs to and from the retreat.

2. Deposit & Payment Terms

You have the choice to either pay in full - or - pay a $500 deposit to save your spot in the Retreat. If paying in full, your spot and your choice of lodging is reserved for you at the time of your purchase. 

If paying a $500 deposit, your spot in the Retreat is reserved, but NOT your choice of lodging. You will have the opportunity to indicate your top 2 preferences for lodging, in order. While we will do our best to give you your top choice of lodging, your lodging preference is only guaranteed when you have paid the remaining balance in full, or initiated a payment plan for the remaining balance. Payment plans are available by request, and have their own terms & conditions. 

If paying a deposit, the remaining balance is due on or before May 1, 2024. It’s recommended you pay your balance much earlier, to guarantee your choice of lodging. 

If full payment is not received by May 1, 2024, we reserve the right to cancel your reservation and fill your spot. We will make every effort to avoid this situation by contacting you prior to and on the day of the balance due date.

3. Retreat Payment

Payment can be made by credit card or PayPal via the website. If full payment is not received by May 1, 2024, we reserve the right to cancel your reservation and fill your spot. We will make every effort to avoid this situation by contacting you prior to and on the day of the balance due date.

4. Cancellation Policy

$300 of the initial payment is nonrefundable. The remaining balance is refundable until 90 days before the event. If canceling under 90 days before the event begins, 50% is non-refundable and the remaining 50% is transferable to a Sacred Sound Lab offering, online or in-person. If canceling within 30 days of the retreat, payments are NON-REFUNDABLE. 

There will be no refunds or discounts for arriving late, leaving early, flight cancellations, travel delays, or illness. 

If you wish to cancel your retreat you must notify Sacred Sound Lab in writing via email at [email protected]. 

5. Travel & Meals 

All Participants are responsible for their own travel costs to and from the Retreat. 

Participants will have all meals provided to them by CMZC during the planned programing, starting with dinner on the first day through breakfast on the last day. 

Should participants have any dietary restrictions that need accommodation, CMZC can accommodate non-gluten, non-dairy, and vegan diets for an additional fee of $10 per person per day, to be collected by Sacred Sound Lab and passed onto CMZC. Other allergies such as nuts, soy, nightshades, or other foods should be communicated to Sacred Sound Lab so that the CMZC kitchen so we can warn guests if they are used in a particular meal. Participant is required to share said dietary restrictions with Sacred Sound Lab and pay the additional $10/day fee, at least three weeks before the start date of the Retreat. You understand that, should Participant delay in sharing any dietary restrictions with Sacred Sound Lab and paying the additional $10/day fee, past this three (3) week period, the Company cannot guarantee that their dietary restrictions will be accommodated. The Company, CMZC, and any chefs or caterers participating in Retreat shall not be held liable for any illness or allergic reaction to any food items provided during the Retreat. 

6. Consumption of Alcohol and Drugs 

Consumption of alcohol and drugs is not allowed at CMZC. In consideration of these rules, You agree not to consume alcohol or drugs on the CMZC premises. Participants violating these rules may be sanctioned or expelled from the Retreat without a refund at the discretion of CMZC and/or Sacred Sound Lab. 

7. Covid-19 Safety

We will abide by CMZC’s Covid 19 Safety Policy as described on their website. This may be be updated from time to time. A proof of a negative covid test (PCR or over the counter) may be required prior to, or on, the day of check-in. This requirement will be communicated well in advance of the Retreat. If you test positive or fail to provide proof of testing, you may not be allowed to attend the retreat and there are no refunds. We recommend travel insurance that covers COVID-19. 

TRAVEL INSURANCE 

8. Travel Insurance

All participants are strongly encouraged to purchase and maintain travel/trip insurance during the entire length of the Retreat (including through their return date). We recommend you purchase a comprehensive “Cancel for Any Reason” policy. In the event you are ill and cannot attend your retreat, or for any other reason that you can’t attend, you will need to submit a claim to your trip insurance company for reimbursement (reimbursement subject to the approval/terms of your specific policy). There are no refunds from Sacred Sound Lab if canceling within 30 days of the retreat, for any reason. 

Participants that choose to purchase coverage are individually responsible for paying for travel insurance and ensuring adequate coverage. Sacred Sound Lab is not responsible or liable for any loss, damage, expense, cost, or any other travel issue. 

Sacred Sound Lab is not a trip insurance provider and is not responsible for the specific terms of your policy. Insurance reimbursement for a Sacred Sound Lab Retreat is not within Sacred Sound Lab’s control and this information does not constitute insurance advice. Please consult an insurance professional and understand your policy coverage limits so there are no surprises for you.  

9. Retreat Cancellation by Sacred Sound Lab

In the rare case of a Retreat cancellation by Sacred Sound Lab (due to circumstances including, but not limited to, natural disasters, manmade disasters, political upheaval, COVID-19, other diseases/pandemics, etc) we will transfer your payment to the next Sacred Sound Lab retreat to be offered within 12 months, or another in-person or online Sacred Sound Lab program of equal value.

Sacred Sound Lab is not responsible for any expenses or damages incurred as a result of retreat cancellation by Sacred Sound Lab including preparation costs, airline tickets, travel documents or other expenses. Sacred Sound Lab reserves the right to cancel any retreat prior to departure in the event that there are too few people booked, in which case you will be given a full refund of any and all payments made to us. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses or damages (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport and vaccination charges, or departure, gear purchases, airport and airline taxes).

10. Amendments by Sacred Sound Lab

Occasionally, changes may have to be made (e.g., instructor, class times or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar standard. If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure.

ROOMMATES

11. Roommate Assignments

Retreat Rates are per person. Double, triple, or otherwise advertised shared rooms require shared occupancy for the specified room rate. If you book a shared room without specified roommate(s), we will do our very best to match you with your desired room type and price point. In the event we can’t find you a roommate for your first pick, we will present you with different rooming options.

ACKNOWLEDGEMENT

12. Assumption of Risk

I acknowledge that I have voluntarily enrolled to participate in Sacred Sound Lab retreats. In consideration of SSL allowing me to participate in SSL retreats, I agree to this release of claims, waiver of liability and assumption of risks. On behalf of myself, my heirs, executors, successors, administrators and any other person who may have an interest at common law or by operation of statute, I hereby waive any and all claims I or such parties may have now or in the future. I release from liability SSL and any employees, guides, agents or representatives (“the releasees”) for any personal injury, death, property damage or loss or any nature suffered by me as a result of participation in any activity on the retreat. I release from liability SSL for any cause whatsoever including those arising out of, or in any way connected to or occasioned by the negligence of the releasees.

The terrain, natural areas and mountains are subject to natural forces which result in obstacles and hazards. Risks can include but are not limited to:

1. i) Isolation: SSL retreats may be in mountainous and natural areas which may not be regularly patrolled, communication may be difficult and rescue and medical treatment may not be available for hours.
2. ii) Animals: SSL retreats may include optional hiking in natural areas which may result in encounters with wild animals and insects which may injure or kill.

iii) Weather: conditions vary from retreat to retreat and may include but rapid and/or extreme changes presenting significant challenges.

1. iv) Environmental Risks and Hazards: varying from retreat to retreat and may include but are not limited to: rapidly moving, deep or cold water; insects, snakes and predators, including large animals; falling and rolling rock; lightning, flash floods and unpredictable forces of nature, including weather which may change to extreme conditions without warning. Possible injuries and illnesses include hypothermia, frostbite, high altitude illnesses, sunburn, heatstroke, dehydration and other mild or serious conditions.
2. v) Activities: varying from retreat to retreat and may include but are not limited to: hiking, excursions to sand-dunes, local temples, hot springs. Physical activities include gentle movement, yoga āsana, vocalizing, singing. 

Throughout the retreat, participants are responsible for their own safety.

I acknowledge the enjoyment I receive from the activities of this SSL retreat and the natural outdoor experience, and the opportunity to experience wildlife and nature in a natural surrounding and state, and emotional experiences resulting from personal growth exploration, this is my reason for participating in SSL retreats, and I voluntarily assume all risks associated with these activities and freely waive any and all legal rights that I may have against the releasees.

PHYSICAL & VOCAL TRAINING RELEASE OF LIABILITY

13. Express Assumption of Risk

I, the undersigned, am aware that there are significant risks involved in mild to moderate physical training, vocal training and breathing exercises at high-altitudes, including but not limited to, the physical training inherent to all yoga exercise activities, the vocal training inherent in all singing, and that my participation in any such physical training program carries with it the potential for death, injury, and/or property damage. The risks include, but are not limited to, falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains including vocal strain or injury, wrist strain or tendonitis, those risks caused by terrain, facilities, temperature, weather, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, guests and teachers and lack of hydration. These risks are not only inherent to physical training, but are also present for volunteers and spectators. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participating, volunteering or watching in any physical, vocal or breath-based training, including this yoga of sound and movement program. I realize that liability may arise from negligence or carelessness by the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault. I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger me or others.

I acknowledge that I am willingly participating in these activities and that I have assumed all risks as described above. In consideration for my being allowed to participate in the activities offered, I, the undersigned hereby release SSL, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. If I am signing on behalf of a minor child, I also give full permission for any person connected with the hosting organization to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child.

GUESTS: You assume all risk of damage or injury to any individuals that you invite as guests at the Retreat, whether you are present or not at the time of damage or injury, and hereby agree to fully indemnify the Released Parties against any claims for damages or injury suffered by your invited guests.

Indemnification: The participant recognizes that there is risk involved in the types of activities offered. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless Sacred Sound Lab, CMZC, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered. This includes but is not limited to parks, recreational areas, playgrounds, areas adjacent to main building, and/or any area selected for training.

ALLERGEN ENVIRONMENT

14. Food Allergies and Allergies Notification, Acknowledgement, and Release of Liability

An environment free of allergens, including but not limited to food allergens, CANNOT be guaranteed on a Sacred Sound Lab retreat, and further, at the CMZC. Therefore, the released parties cannot guarantee that any particular food product is free of all traces of any particular allergen, that consumption of a food product will not result in some form of allergic reaction, or that the participant will not come into contact with any allergens while in attendance on SSL retreats. The undersigned acknowledges and agrees that i) she/he is aware of such risks and that participation in the event will expose the participant to food, activities and persons that may result in exposure to allergens and injury and, in that regard and assuming such risks, the undersigned hereby fully releases and discharges the Released Parties from any and all liability and/or responsibility to the participant, the undersigned, or any third party for death and/or injuries to the participant, and/or any direct, indirect, punitive, incidental, or any damages that arise out of or relate to participant’s participation in SSL retreats and/or exposure to food allergens.

MEDIA

15. Permission for Capture and Use

Media is defined as photography, video, written or verbal testimonial, or any other form of capturing likeness. For valuable consideration received, I grant to SSL the absolute and irrevocable right and unrestricted permission concerning any captured media that she/he has taken or may take of me or in which I may be included with others, to use, reuse, publish, and republish in whole or in part, individually or in connection with other material, in any and all publishing platforms now or hereafter known, including the Internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if she/he so chooses. I release and discharge SSL from any and all claims and demands that may arise out of or in connection with the use of the media, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, Videographer, Interviewer, Editor, as well as the person(s) for whom he/she captured the media. I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns.

CODE OF CONDUCT

16. Code of Conduct 

We are dedicated to providing a safe and harassment-free experience for everyone. “Harassment” includes, but is not limited to offensive verbal comments related to gender, gender identity and expression, age, sexual orientation, disability, physical appearance, body size, race, ethnicity, religion, deliberate intimidation, stalking, following, harassing photography or recording, sustained disruption of talks or other events, inappropriate physical contact, and unwelcome sexual attention. We do not tolerate harassment of Retreat participants in any form. Participants asked to stop any harassing behavior are expected to comply immediately. Participants violating these rules may be sanctioned or expelled from the Retreat without a refund at the discretion of the Retreat organizers.

Further, You agree to follow all directions and instructions given by staff of the CMZC. Participants violating the policies and procedures of CMZC may be sanctioned or expelled from the Retreat by CMZC without a refund at the discretion of CMZC. 

WAIVER

17. Release and Waiver of Liability

As consideration for being permitted by SSL to participate in these activities, I hereby agree that I, my assignees, heirs, distributees, guardians, and legal representatives will not make a claim against, sue or attach the property of SSL, CMZC, their affiliates, employees, agents or volunteers or any of their affiliated organizations for injury or damage resulting from acts, howsoever caused, by any employee, agent, or contractor, or any of their affiliated organizations, as a result of my participation in SSL retreats. I hereby release SSL, and any of their agents or affiliated organizations from all actions, claims or demands that I, my assigns, heirs, distributees, guardians, and legal representatives now have or may hereafter have for injury, damage, or death resulting from my participation in SSL retreats.

I am medically, physically, emotionally and in all respects fit and able to participate in SSL retreats.

I agree I will be fully and financially responsible for my own physical condition and well-being during the retreat and will follow the safety precautions and instructions prescribed by SSL.

I acknowledge that SSL may make suggestions from time to time that are intended to help me and my well-being. However I take ultimate responsibility for my choices and realize that SSL is not licensed medical provider and that I must consult my doctor.

If I experience pain or discomfort during the retreat, I will modify SSL’s instruction to suit my individual needs. I will not hold SSL responsible for any pain or discomfort I experience during or after the retreat. I understand that the activities offered on this retreat are not a substitute for medical care. I understand that SSL is not qualified to perform spinal or skeletal adjustments, diagnose vocal injury or make any other diagnosis, prescribe, or treat physical or mental illness.

For the benefit of everyone on your SSL retreat, SSL reserves the right to accept or reject any participant at any time without liability, and in the event it determines, in its sole and exclusive discretion, that a participant is disruptive to the harmony of the retreat, it may without any obligation to pay a refund or any other amount whatsoever, expel such participant from the retreat. SSL will carry no responsibility or liability for any participant who leaves the retreat prior to its conclusion or for any activity undertaken by any participant which is not included on the retreat itinerary.

COVID-19 WAIVER

18. Sacred Sound Lab cannot prevent you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while utilizing Sacred Sound Lab services on CMZC premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize Sacred Sound Lab services and/or enter onto CMZC premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

By agreeing to the terms outlined here and elsewhere on the SSL website I hereby release and discharge my rights and claims for damages or liabilities that may occur as a result of participation on a SSL retreat.

 

This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws rules.
